Under Oregon law, people are prohibited from driving a vehicle when their blood alcohol content (BAC) is .08 percent or higher. They may not drive while they are under the influence of alcohol, marijuana, inhalants, or other controlled substances. Even if you are arrested for a DUII and no conviction occurs, you may still face the suspension of your driver’s license for a period of time.
When it comes to DUII convictions, mandatory minimum sentences are used to determine the consequences for the corresponding offense. Depending on the number of previous DUII convictions the individual has, the amount of time that has elapsed between convictions, and a number of other factors, the punishments can vary greatly. First-time offenders may spend up to one year in jail, pay at least $1,000 in fines, face a one-year license suspension, have an IID installed for a period of one year, or face additional penalties at the discretion of the judge. With each subsequent offense, the duration and cost of these consequences increases.
